Your point is well taken.  I note that, as I understand it, the DMCA
only provides civil remedies for this sort of violation.  If this is
true and NAI no longer sells the commercial product, the loss sustained
by them is likely negligible (or zero) and they may have no case. 

Nonetheless, I appreciate your clarification on this issue for the group.
