I think you are right on this point.  But it does matter if the boat
could not be detected - sort of.

According to the reports I have seen, the boat ran into the submarine -
not the other way around.  So perhaps when you run into another ship's
side you are at fault? Except of course that in the ocean, it is the job
of the larger ship to get out of the way.  But if you are cruising along
and someone else smashes into you, it seems to me to be their fault.

Isn't it 'outdriving your headlights' to go so fast that you can't stop
before you hit something?

Right.  If they did not follow the rules and had a crash he will be
blamed.  But I think he will be blamed anyway.   This has to do with
politics, not seamanship.  W has already said he is sorry.
