I suppose there are points to be made on both sides of the Napster issue.

"Fair Use" law allows individual consumers to make copies for themselves,
(and pragmatically speaking, their friends,) with the understanding that
the copied materials are not thus "marketed for profit" to the public.

Napster is "a bit like that", except that the scale of operations, arguably,
far transcends the "me and a few friends" criteria.  So I think that the
"Big Media" are right to worry.  I suspect that their worry, however, has
less to do with reduced sales of the works they (under contract) market,
than it does in the emergence of an alternate "popular venue" for promotion
and "star-making"; their back-room deals become less than earth-shaking.

The "I'll make sure you never work in this town again!" forms of
blacklisting lose most of their force of threat.

If left unchecked, it may reduce the music "industry" to revenue from
live performance management.  With technology headed inexorably toward
greater individual capability, trying to charge for "recorded viewing"
will become too much like "charging for breathing air."  In a way, we
are already there.

Perhaps, as Drew points out, one of the best outcomes would be that this
episode will lead to the introduction of a reasonable "micro-payment" system.
But the issues of "tracking usage" are problematic from both technical and
privacy perspectives.

Finally, the (possible) demise of Napster may lead to far greater adoption
of the "gnutella-style" serverless sharing systems by the public.  This is
an outcome that may have substantial repercussions for overall information
security (see "FreeNet") in which arbitrary collections of systems contribute
(knowingly or otherwise) to virtual and anonymous storage and distribution
points of arbitrary, encrypted content.  Such an outcome must be of concern
to the law-enforcement and intelligence communities, as well as it serves
to greatly empower individuals and groups.
